History of Case

  • July 21, 1981

    • Annette Villeneuve signed a Last Will and Testament making Attorney Richard J. Gabriel Executor.

    • Trust Instrument signed giving Attorney Richard J. Gabriel total control of the Trust with the "Trustee shall receive reasonable compensation for his services hereunder." which basically means he can pay himself anything he wants from the Trust and can be challenged by no one.

  • January 28, 1987

    • Annette Villeneuve signed a new Last Will and Testament changing the terms of the 1981 Will drastically using a different attorney.  Click Here to See Will.    

    • NOTE THAT ON PAGE 2 ARTICLE III: "I have intentionally made no provision for my granddaughter PAMELA CONSTANZO, of Marlboro, Massachusetts, and it is my intention that she receive no part of my estate." 

      • The woman on the right in this picture is Pamela Constanzo celebrating the death of Annette Villeneuve in Annette Villeneuve's kitchen approximately an hour after her death.  Note all the documents in her arms.  Click Here to See the Celebration Picture.

  • December 5, 1995

    • Annette Villeneuve signed a Codicil to the 1987 Will naming Attorney Richard J. Gabriel the Executor and Trustee of her estate.  The notary, Francis P. Halliday is also a witness to the Codicil which is clearly a conflict of interest. Click Here to see a copy of the Codicil.

      • Note the Following:

        • Attorney Richard J. Gabriel is a Witness

        • Francis P. Halliday is a Witness and also the Notary.  We believe it is illegal to notarize a document that you are a witness (you can not notarize your own signature!

        • Attorney Richard J. Gabriel filed a Motion with the Court claiming that "He became aware of a Will and Codicil when it was FAX'd to him by attorney Summers on February 7, 2007."  Click Here to see Motion.  Attorney Richard J. Gabriel appears to have drawn up the Codicil, is a Witness to it, and struck the bequests in the exact order they appeared in the 1987 Will yet didn't know about its existence?  If he lied in this Motion with the Court this is perjury yet he has not been charged with perjury.  ARE LAWYERS EXEMPT FROM THE PERJURY LAWS IN MASSACHUSETTS????

  • June 11, 1997

    • Both QUIT CLAIM DEEDS were recorded (probably by mistake) on 3/2/1998 when two mortgages were recorded for the properties.

    • There is no logical explanation as to why Annette Villeneuve would knowingly sign these documents if she knew what the they were.  It is not known if she even knew who Francis P. Halliday was.  What reputable attorney would advise their client to give their property away to a stranger????

    • If Annette Villeneuve had not wanted to take out mortgages on these properties in 1998 would this QUIT CLAIM Deed have been done.  One theory to explain the second QUIT Claim Deed is as follows:

      • Annette Villeneuve did not understand that she was basically giving her property away when she signed the first QUIT Claim Deed.

      • When she wanted to take out mortgages in 1998 Richard J. Gabriel, as the closing attorney on the mortgages, didn't want to tell her that she didn't own the properties any more so the second QUIT CLAIM Deed was done. 

      • he second QUIT CLAIM Deed dated June 11, 1997 was then created to give her the property back. 

      • If Annette Villeneuve hadn't taken out the mortgages in 1998 on these properties upon her death it is highly likely that the QUIT CLAIM DEED conveying the property would have shown up as follows:

        • Upon her death the first QUIT CLAIM Deed would have surfaced as an unrecorded but valid deed and probably another QUIT CLAIM Deed transferring the property from Francis P. Halliday to Richard J. Gabriel.

        •  A search of the Worcester County Registry of Deeds finds many QUIT CLAIM Deeds with Richard J. Gabriel being a party on the Deed. 

Makes you kind of wonder, doesn't it?

  • February 26, 1998

    • Annette Villeneuve took out two mortgages - one on 154 Howe Street and one on 158 Howe Street for $55,000 each.

      • Surprise - Surprise - these are the same properties the QUIT CLAIM Deeds mentioned above were done on nine months earlier and Attorney Richard J. Gabriel was the notary on the QUIT CLAIM Deeds and the Closing Attorney on the mortgages.

      • The Two Mortgages were recorded on March 2, 1998 - the same day the two QUIT CLAIM Deeds dated June 11, 1997 were recorded.

      • Written next to the Collateral for the Mortgage on 158 Howe Street is " Lots 15 + 16" yet they are initialed by no one.  Click Here to See Mortgage.

      • No Discharges have been filed on these mortgages yet the Temporary Executor and Special Administrator never made payments on these mortgages (we believe they have been paid off but the discharges never recorded).

      • In Attorney Richard J. Gabriel's First and Final Accounting he claims to have made the mortgage payment to  First  Horizon  Mortgage for 158 Howe Street yet First Horizon Mortgage holds the mortgage on 141 Howe Street.  Click Here to See Attorney Richard J.       • QUIT Claim Deeds on 158 Howe Street, Mortgage with Collateral hand written on it without the borrowers initials, and No mortgage Discharges recorded.  Makes you kind of wonder, doesn't it???

  • April 24, 1998

    • Annette Villeneuve took out a $100,000 mortgage on one of her property.  Francis Halliday was the witness on this mortgage.  Recognize the name????  Francis Halliday was the Notary on the 1995 Codicil.

    • When Attorney Richard J. Gabriel re-entered Annette Villeneuve's life in 1995 she had almost no debt.  Between February 26, 1998 - April 24, 1998 Annette Villeneuve took out $210,000 in mortgages.   On the two mortgages for $55,000 each Attorney Richard J. Gabriel is the witness.  On the $100,000 mortgage Francis Halliday is the witness.  Attorney Richard J. Gabriel and Francis Halliday were witnesses to the 1995 Codicil naming Attorney Richard J. Gabriel as Executor and Trustee and Francis Halliday was the notary.  It would be nice if Francis Halliday could be questioned about his relationship with Attorney Richard J. Gabriel and Annette Villeneuve but he is dead - he died in 2002.

  • June 8, 1999

    • Francis P. Halliday resigned as Trustee of a Land Trust that Attorney Richard J. Gabriel and Janette Gabriel are the sole beneficiaries.  Click Here to see.

    • It would be interesting to know where the properties in this Realty Trust are acquired from.  Makes you kind of wonder, doesn't it???

  • 2006

    • Annette Villeneuve was ill most of the year and in and out of the hospital continuously.

    • Sometime in the late summer her granddaughter, Pamela Constanzo, started showing up to visit her grandmother and acted concerned for Annette Villeneuve's well being.  It is interesting to note that we heard that Pamela Constanzo had nothing to do with her grandmother or father for many, many years and it is believed that Annette Villeneuve's grandchildren never once invited their grandmother or father to their homes.  As Annette Villeneuve is nearing the end of your life Pamela Constanzo now shows up to visit - the person who gets nothing in the valid 1987 Will.

    • Attorney Richard Gabriel, we have been told, called Annette Villeneuve continuously in the last two to three months of her life trying to get her to sign a new Will which Annette refused to sign.

    • Click Here to see the "so called" last minute Will Annette Villeneuve didn't get around to signing.  Attorney Richard J. Gabriel said this to the judge during a hearing on May 30, 2007. Note the following:

      • All beneficiaries in the valid 1987 Will are stricken in this Will.

      • Attorney Richard J. Gabriel and Pamela Constanzo are co-trustees but only Attorney Richard J. Gabriel has any decision making power.

      • Any income for Annette Villeneuve's son is at the sole discretion of Attorney Richard J. Gabriel (he doesn't have to provide Annette's son with a dime).

      • Upon the death of Annette Villeneuve's son Pamela Constanzo gets everything.  What rational person would believe that Annette Villeneuve would leave everything to the person she specifically disinherited in her valid 1987 Will????  Makes you kind of wonder, doesn't it.

      • Here is a statement that was an exhibit to a document filed with the court that we heard the judge calls "The Thing" by one of her dearest friends which we believe shows what Annette Villeneuve thought of Pamela Constanzo.  Click here to see statement.

  • January 8, 2007

    • Annette Villeneuve dies at age 90.

    • Shortly after Annette Villeneuve's death her granddaughters Pamela Constanzo and Deborah Peterson Boulay arrive at her home with a friend to celebrate the death of Annette Villeneuve.  Click Here to see the "Grieving Granddaughters" in Annette Villeneuve's kitchen shortly after her death.  They were in the house for hours removing items from the house when they had no right to remove anything from this estate.  Note the many envelopes, even a picture frame, in Pamela Constanzo's arms in the picture.  Deborah Peterson Boulay appears to have Annette Villeneuve's purse in her hands which Annette brought to bed with her every night.

      • There were witnesses in the house who observed the spectacle of Pamela Constanzo and Deborah Peterson Boulay grabbing everything they could grab. 

WHY HAVEN'T THESE PEOPLE BEEN ARRESTED FOR WHAT APPEARS TO BE THE REMOVAL OF PROPERTY THAT WAS NOT THEIR PROPERTY WHICH WOULD BE CONSIDERED GRAND LARCENY?

  • January 9, 2007

    • According to Attorney Richard J. Gabriel's bill for Service Rendered dated 4/3/2007 he shows "Calls and Returned Calls about Annette".  Who did he call and what did he discuss?   According to his Motion that he filed with the court "I became aware of a Will and Codicil when it was Fax'd to me by attorney Summer on February 6, 2007."

      • Click here to see Motion Filed with Court by Attorney Richard J. Gabriel where he claims he wasn't aware of the Will and Codicil which named him Executor and Trustee until it was fax'd to him by attorney Summers on February 6, 2007.

      • Pamela Constanzo arrives at the property and is seen making a phone call on her cell phone and leaves.

      • Pamela Constanzo comes back to the property, announces she is "Custodian of the Properties", and has her husband change the locks on 141 Howe Street.  She then threw Annette Villeneuve's long time caretaker and housekeeper out of the house and threw her things in the street.  Annette Villeneuve's long time care taker was her niece Rita St. Onge.

        • WHO MADE PAMELA CONSTANZO "CUSTODIAN OF THE PROPERTIES" AND WHAT RIGHT DID SHE HAVE TO CHANGE THE LOCKS AND TAKE CONTROL OF THE PROPERTIES??????

          • Did Attorney Richard J. Gabriel call and return calls to Pamela Constanzo on January 9, 2007?

      • Pamela Constanzo starts showing up at 141 Howe Street each day to "take care of Daddy".  Attorney Richard J. Gabriel stated in court on May 31, 2007 that Pamela Constanzo goes to the house each day to take care of her father and give him his "medications".  We don't know what she was giving him but a police report showing a traffic incident AFTER Pamela Constanzo started taking care of her father is interesting.  Click here to see this Police Report.

        • It is believe that Eugene was returning home from The Elks in Hudson that day and had only drank ginger ale (people at The Elks can verify this).

        • Eugene Villeneuve was a Teamster truck driver for many years and is believed to have never had a driving problem or drank alcohol.  After Pamela Constanzo started to take care of him and give him his "medications" he got two tickets in a one month period.

  • January 10, 2007

    • According to Richard J. Gabriel's billing for 1/10/2007 he lists "Met with Pamela, her husband, and Jeffrey Villeneuve.  Investigated for will, called bank for safe dep box & atty August.  Also spoke with Atty Summers.

      • The only document that Attorney Stuart August's name appears in is the valid 1987 Will that Attorney Richard J. Gabriel stated in a Motion filed with the court under penalties of perjury "I became aware of a Will and Codicil when it was Fax'd to me by attorney Summer on February 6, 2007."

        • If Attorney Richard J. Gabriel didn't have a copy of the Will and Codicil until February 6, 2007 how did he know to call Stuart August on January 10. 2007?????  Click here to see valid 1987 Will.

        • Did he call Stuart August as he claims?  Stuart August is dead so how did he call him????

  • January 21, 2007

    • Attached is a copy of the Letter given to Annette Villeneuve's tenants by Eugene Villeneuve.  Knowing Eugene Villeneuve's mental state it is inconceivable he wrote this letter.  None of Annette Villeneuve's would give him their rent checks - they made them out to "The Estate of Annette Villeneuve".    Click here to see the letter..

      • Eugene Villeneuve had no right to be collecting rents until this estate went to Probate.

  • January 27 - February 1, 2007

    • Pamela Constanzo, who has basically taken control of the estate, is always at 141 Howe Street on the 27th and 1st of each month to get the mail.  Annette Villeneuve and Eugene Villeneuve Jr. got their social security checks by mail each month.  Eugene Villeneuve Jr. got a disability check on the 27th of each month and the social security checks came on the 1st of each month.  Since Richard Gabriel was not appointed temporary executor and the mail was not forwarded until September 21, 2007 the following questions arise:

      • Did anyone notify social security of Annette Villeneuve's death and if so when?

      • What happened to Annette Villeneuve's social security check in Februray and if social security was not informed of her death, what happened to the subsequent checks?  Were they cashed and if so by who?

      • What legal right did Pamela Constanzo have to be removing mail from 141 Howe Street and why was she not arrested for tampering with mail?  There are multiple pictures proving she removed mail from 141 Howe Street and the 27th and 1st became known as "CHECK DAY" on Howe Street since Pamela Constanzo always showed up to get the mail on these days.  Possible reasons why Pamela Constanzo has not been arrested for tampering with the mail is:

        • Pamela Constanzo's husbands father used to be a Marlboro Policemen.

        • Pamela Constanzo's sister, Deborah Peterson Boulay, is married to John Boulay who is a mail man in Marlboro.

      • Pamela Constanzo stopped coming to 141 Howe Street after the mail was finally forwarded by Special Administrator William Crowley on September 21, 2007.  How did she know the mail had been forwarded???

  • February 2, 2007

    • According to Attorney Richard J. Gabriel's bill for services rendered dated April 3, 2007 he states "Met with Eugene Villneu gave copy of wills that I at the time and discussed how to get in safe deposit box." 

      • What Will did he give Eugene Villeneuve - the valid 1987 Will that he claimed he was unaware of until February 6, 2007????

  • February 23, 2007

    • According to Attorney Richard J. Gabriel's bill for services rendered dated April 3, 2007 he states "Attempted to speak with Pam Constanzo to find about what was in the Box mad several calls she finally returned my call on Feb 20, 2006 she wanted a copy of the will and Codicil.  She picked it up on 2/21/2007 and I spoke to Kevin Hart on 2/23/07 and I found out there was no will in the box."

      • Attorney Joseph Connelly was representing Eugene Villeneuve and the Villeneuve grandchildren at this time and arrange for the safe deposit box to be drilled.  Click Here to see letter from Joseph Connelly indicating he represented Eugene Villeneuve and the Villeneuve grandchildren.

      • On February 23, 2007 attorney Richard J. Gabriel now had the Will and Codicil Fax'd to him by attorney Cathleen Summers on February 6, 2007.  What right did attorney Richard J. Gabriel have to give a copy of the Will and Codicil to Pamela Constanzo before it was filed with the court when Pamela Constanzo gets nothing from this estate?????

  •  February 28, 2007

    • Attorney Richard J. Gabriel files Will and Codicil with the court and had his temporary Executorship allowed. 

  • March 3, 2007

    • According to Attorney Richard J. Gabriel's bill for services rendered dated April 3, 2007 he states "Went to Marlboro and met with Pam, her sister, and Eugene, got information about addresses and tenants and where the Highland st money was.  I then went and introduced myself to some tenants and left letter of intro with others."  Click Here to see the letter he gave to the tenants.

      • Richard J. Gabriel represented the Estate of Annette Villeneuve yet is meeting with Pamela Constanzo who was disinherited in the valid 1987 Will.

      • The Highland Street property was sold by Annette Villeneuve in August of 2006 and any proceeds are part of the estate.  The sale of the Highland Street property by Annette Villeneuve's death caused the following changes from what the Will states:

        • Eugene Villeneuve does not have a life estate to any property since the property he was given a life estate to, 149 Highland Street, Marlboro, MA, was sold prior to Annette Villeneuve's death which extinguished the life estate.

        • The Villeneuve grandchildren are no longer entitled to the proceeds from the sale of the Highland Street property since it was sold prior to Annette Villeneuve's death.

        • Click Here to see the Deed Transfer for the Highland Street property.  Notice the signature of Annette Villeneuve on this document has no middle initial "T" since Annette Villeneuve never signed documents with her middle initial.  The only difference between this document signature and other document signatures is that attorney Richard J. Gabriel was not involved in this transaction.

        • Click Here to see the 1998 mortgage on 158 Howe Street and note the signature page.  This one has a "T" and Attorney Richard J. Gabriel is the witness.  On documents done by Attorney Richard J. Gabriel there is always a middle initial "T".  

Makes you kind of wonder, doesn't it????

  • April 3, 2007

    • Pamela Constanzo shows up at Tenant Marge McCabe's apartment demanding the rent.  Click here to see Marge McCabe's statement.

    • Attorney Richard J. Gabriel claims in a Motion filed with the court, under penalty of perjury, that he never represented Pamela Constanzo or retained her services yet he is meeting with her repeatedly and she is demanding rents from the tenants and he takes no action.  Click here to see Motion.

ARE LAWYERS IN MASSACHUSETTS EXEMPT FROM THE PERJURY LAWS????  TO THE BEST OF OUR KNOWLEDGE ATTORNEY RICHARD J. GABRIEL, WHO, IN OUR OPINION, COMMITTED PERJURY IN STATEMENTS MADE DURING COURT HEARINGS AND IN FILINGS WITH THE COURT HAS NOT YET BEEN CHARGED WITH PERJURY.  WHY?????

  • Around April 18, 2007

    •  A Motion is filed by James F. Pazzanese and James P. Pazzanese objecting to Richard J. Gabriel's Motion requesting an extension of his Temporary Executorship which expires on May 18, 2007. 

  • May 18, 2007

    • David M. Gabriel, 232 Essex Street, Beverly, MA 01915 enters the case representing his brother Richard J. Gabriel.

      • Please note that in many wills drawn up by Richard J. Gabriel, including the so-called "Last Minute unexecuted Will of Annette Villenuve" that she did not get around to signing even though it was written up over a year before her death, David M. Gabriel is nominated as Executor and Trustee if Richard J. Gabriel is unable to serve.

  • May 31, 2007

    • A hearing was held with Judge McSweeney, III presiding on Richard J. Gabriel's Motion to extend his Temporary Executorship.  The following occurred during the hearing:

      • The judge was informed that Richard J. Gabriel has not maintained the properties nor been paying most of the just debts of Annette Villeneuve, including her funeral expense and she had died almost five months prior to this hearing.

      • The judge asked if their were sufficient funds to pay her funeral expenses and was told yes (Annette Villeneuve had approximately $141,000 in cash at one bank at the time of her death).

      • At this point attorney Richard J. Gabriel starts yelling at the judge and shaking his finger in the judge's face and says "I can only pay bills of an emergency nature, your honor, UNTIL YOU MAKE ME PERMENENT EXECUTOR, in my opinion."

      • The judge then asked attorney Richard J. Gabriel if he was an attorney.

      • Attorney Richard J. Gabriel screams "I am Richard J. Gabriel, attorney at law".

      • We heard the judge then said "just checking".

      • The judge ended the hearing without ruling and "took it under advisement".

      • Later that day he signed the order naming William F. Crowley Special Administrator and refused to extend Richard J. Gabriel's Temporary Executorship.

ALTHOUGH THE ORDER WAS SIGNED ON MAY 31, 2007 THE CLERK OF COURTS OFFICE DIDN'T NOTIFY ANYONE UNTIL LATE JUNE.  WHY THE DELAY???

  • Upon returning to Marlborogh James P. Pazzanese found a notice from an insurance inspection company on his door. Click Here to see notice.

    • Who asked for this inspection??

    • The only time these are done is when property is being sold.

    • Did Attorney Richard J. Gabriel already have a Purchase and Sale Agreement on the estate's property??

Makes you kind of wonder, doesn't it.  Attempts to seize control of these properties began in 1997 with QUIT Claim Deeds.  Could these attempts still be going on after the death of Annette Villeneuve???

 

  • June 8, 2007

    • Attorney Richard J. Gabriel writes out two checks from his IOLTA (Client Account) to pay bills of the Estate of Annette Villeneuve.  Click Here to see the two checks.

      • Attorney Richard J. Gabriel's Temporary Executorship expired on May 28, 2007 and the judge did not extend it at the May 31, 2007 hearing.  The judge instead appointed William F. Crowley Special Administrator.

      • We believe it is against the rules on IOLTA accounts, which are under the supervision of the Board of Overseers,  to pay client bills prior to the funds being put into the account.  Since Attorney Richard J. Gabriel was not Temporary Executor after May 28, 2007 he violated these rules and this may have been an illegal act.

 

  • June 22, 2007

    • Remainder interest of the Will John J. Pazzanese sends William F. Crowley an email to attempt to bring him up to speed on the estate matters.  Click Here to see email.

      • Per "Affadavit of William F. Crowley" (Click Here to see)  filed with the court on August 15, 2007 note the following:

        • Spoke with Pamela Constanzo, who was specifically disinherited in Will, on 6/22/2007, 6/26/2007, 7/9/2007, 7/10/2007 (and letter), and 7/13/2007.  Why is this estate being charged for conversations with someone who has no standing whatsoever???

        • Went or spoke with Kristie Warner at Marlborogh Co-Operative Bank on 6/26/2007, 6/29/2007 (twice), 7/5/2007, and  7/10/2007.  What were these conversations about???

        • No indication William Crowley contacted St. Mary's Credit Union per email request.  It is known he went there on September 21, 2007 but not what he found out.

        • On 7/13/2007 William Crowley spoke with attorneys Peter DiTommaso and Peter Kachajaian and received documents from them concerning the sale of a property at 149 Highland Street, Marlboro, MA that Annette Villeneuve sold in August of 2006 prior to her death.  The sale of this property extinguished the life estate for Eugene Villeneuve Jr. and prevents three of her grandchildren from getting the proceeds from the sale of this property since it was done prior to her death.  We believe the reason that Annette Villeneuve sold this property at a fire sale price was to prevent her grandchildren from getting any of her properties.

          • It is believed that a condition of sale of the 149 Highland Street property was that $50,000 had to be put into escrow for possible future repairs.  NO ONE SEEMS TO BE KNOW WHAT HAPPENED TO THE $50,000.  

  • July 2, 2007

    • Attorney Kurt Hayes sends a letter to Special Administrator William F. Crowley with the following issues (Click Here to See Letter):

      • Eugene Villeneuve Jr. does not have a Life Estate to 141 Howe Street, Marlboro, MA per the Will and as a matter of law.

      • Pamela Constanzo, who has no standing in this case and was specifically disinherited in the valid Will, still has the keys to 141 Howe Street and continues to go and possibly remove items from the house without authority.

        • Neither Temporary Executor Richard J. Gabriel nor Special Administrator William F. Crowley ever had keys to 141 Howe Street, Marlboro, MA which was the home of Annette Villeneuve until approximately November 27, 2007.  It is our opinion that they both failed to meet their fiduciary responsibilities to this estate by failing to secure the assets of this estate.

      • Repairs are needed at 154 Howe Street.

        • Special Administrator did not have the repairs done until after the front door at 154 Howe Street came off the hinges injuring a tenant and resulting in an insurance claim.  Failing to maintain the properties, in our opinion, was negligence which exposed this estate to massive potential lawsuits.

  • Sometime between May 31, 2007 and September 14, 2007

    • Attorney Kurt Hayes filed a Motion to Withdraw from the Case.

    • Judge McSweeney denied the Motion.

    • Kurt Hayes never showed up for a hearing after May 31, 2007.

    • To the best of our knowledge no action against Kurt Hayes has been taken by the Bar of Overseers.

  • August 16, 2007

    • Special Administrator files with the Court "Special Administrator's Motion for Court Approval of Payment of Certain Bills of The Estate".

    • A hearing was set for August 30, 2007 on this Motion.

    • The bills under Section A were paid prior to the hearing.

    • The Bills under Section B. Were not paid until around 12/27/2007.

  • August 30, 2007

    • The scheduled hearing was not held due to William F. Crowley putting the wrong docket number on the filing.  The judge told the lawyers to meet and discuss the case since they were already there.

    • The lawyers present were:

      • Richard J. Gabriel

      • William F. Crowley

      • Cathleen Summers

    • After the meeting Special Administrator William F. Crowley wrote a letter to Richard J. Gabriel and Cathleen Summers recapping what was discussed.  Base on the letter it appears William Crowley understood the following:  Click Here to see letter.

      • The intended, yet unexecuted, new Will of Annette Villeneuve, was a last minute will that she didn't get around to signing.  The unexecuted will is dated January 1, 2006 - fully a year before Annette died and does not provide a life estate to her son Eugene Villeneuve or a set income - Richard Gabriel will determine what, if any income, Eugene Villeneuve gets.  Upon the death of Eugene Villeneuve Pamela Constanzo gets everything.  The person who gets nothing in the valid 1987 Will now gets everything.  Annette Villeneuve refused to sign this Will and Richard Gabriel called her multiple times per day in the last few months of her life trying to get her to sign this will (her caretaker can verify this).  This unexecuted will may have been Pamela Constanzo and Richard Gabriel's intended Will - it does not appear to be Annette Villeneuve's intended will.  Click Here to see unexecuted Will.

      • Richard Gabriel paid bills from his personal funds.

        • In reality he paid bills from the IOLTA account and used other clients funds - not his personal funds.  We believe this is a clear violation of the IOLTA rules and may be illegal.

      • Richard J. Gabriel will bow out if he gets paid for his time.

        • Starting on August 30, 2007 Richard J. Gabriel told multiple lawyers he would bow out if paid his fees, told the judge on November 26, 2007 and February 15, 2008 that he would bow out if his fees were paid, and then tried to renege on his agreement.  On February 15, 2008 when he refused to sign the paperwork after he told the judge in open court that he would step aside if his fees were paid the judge called a recess, called the attorneys into chambers, and then Richard J. Gabriel signed the papers.

  • September 7, 2007

    • Attorney Richard J. Gabriel submits the following:

      • Letter Sent to William F. Crowley.  Click Here to see letter.

        • This letter also states that Richard J. Gabriel will step aside if his fees are paid.  Then he adds a requirement that whoever takes his place will take care that Eugene Villeneuve comes first (no one appointed would be acceptable to Richard J. Gabriel).  At the time of this letter Eugene Villeneuve was residing at Bolton Manor Nursing Home in Marlboro where he had been since 7/11/2007.  Eugene's daughter Pamela Constanzo kept telling him he would be going home the next day.  Instead, he died there on 11/26/2007.

        • Notice his multiple referrals to Pamela Constanzo - the person who gets nothing continues to call the shots on this estate.  Why??

      • A copy of the unsigned unexecuted Will.  Attorney Richard J. Gabriel claims in his letter "I prepared for her just prior to her death but that she never got to sign."  The facts show this Will was drawn up more than a year before Annette Villeneuve's death (it is dated January 1, 2006).  Also, according to her long time care taker Richard J. Gabriel called Annette Villeneuve continuously multiple times each day for at least two months before her death and she had screaming conversations with him and told him she will not sign this Will.  There is a significant difference between "never got to sign" and "refusing to sign".  When you review the unexecuted Will please note that the (19) people in the valid 1987 Will are stricken in favor of Pamela Constanzo who was specifically disinherited in the valid 1987 Will.  What reasonable person would believe that the unexecuted Will was prepared per Annette Villeneuve's wishes.  It appears to have been prepared per the wishes of Pamela Constanzo and Richard J. Gabriel.

  • September 14, 2007

    • James P. Pazzanese files what we have heard the judge calls "The Thing" with the court.  Click here to see "The Thing""

      • Attorney Kurt Hayes had been paid approximately $11,000 for filing a few motions and attending a hearing of less than (30) minutes and had filed a Motion to Withdraw which was denied.  In spite of the judge denying the Motion Kurt Hayes was never seen again at a hearing nor did any further work on this case.  However, he did send bills for reading the orders to attend hearings and didn't show up.

      • Attorney Cathleen Summers had been paid approximately $11,000 up to this time with $6,624.06 being paid to her on August 15, 2007 and on September 4, 2007 she sent a letter demanding another $3,000.00 on September 4, 2007.  She had attended a hearing/meetng on August 30, 2007 and did a few other things and was already demanding more money less than three weeks later.

      • Since the lawyers would not file what was necessary so the judge in the case was apprised of what was going on in this case James P. Pazzanese filed it himself.

  • September 20, 2007

    • A hearing was held to Extend William Crowley's term as Special Administrator.

    • No lawyer showed up to represent James P. Pazzanese although attorney Kurt Hayes' Motion to Withdraw was denied and attorney Cathleen Summers failed to show up for the hearing even though she had filed as an attorney of record in this case.  NEITHER ATTORNEY WAS CITED FOR CONTEMPT - WHY?????? ARE ATTORNEYS EXEMPT FROM THE LAW IN THE MIDDLESEX PROBATE COURT????

    • James P. Pazzanese told the judge what had been going on in this estate including William Crowley's refusal to pay bills, maintain the properties, have the lawns mowed, snow plowing done, etc.  The judge asked William Crowley how much money was left.  William Crowley told him the approximate amount left after the bills are paid.  The judge told him "I think there is enough money to mow the lawns."  William Crowley never had the lawns mowed.

    • A pre-trial hearing was scheduled for November 26, 2007.

  • September 21, 2007

    • William Crowley shows up at the properties but only looked at the property lines - did he know something about why Richard J. Gabriel had been trying to get the properties since 1997 - first thru QUIT CLAIM Deeds and then via mortgages????

    • William Crowley was asked if he was going to take the mail?    He took the mail and appears to finally have had the mail forwarded since it stopped coming after this date.  Also, Pamela Constanzo was never seen at the properties again after this date - Did William Crowley call her to tell her the mail was forwarded????  

    • William Crowley was seen at St. Mary's Credit Union.  He told the judge during the February 15, 2008 hearing that he had gone to every bank in Marlborogh and there were no accounts there.  Yet, there was a 1099-INT statement for 2007 from St. Mary's Credit Union proving there was money at St. Mary's Credit Union when she died on January 8, 2007.  What happened to the money????  Click Here to see 1099-INT Statement.

    • A Pre-Trial Hearing was scheduled for November 26, 2007

  • Attorney Cathleen Summers files to Withdraw from the case and it is allowed by the judge.

  • October - November 2007

    • Attorney Alan Garber agrees to advise but not enter the case since he saw "Gold at the end of the Rainbow".

  • October 19, 2007

    • Richard J. Gabriel sends a letter calling a meeting on November 13, 2007 to discuss estate matters. 

      • Does he have the right to even call this meeting?  The judge refused to extend him as Temporary Executor on May 30, 2007 and appointed a Special Administrator.

      • Click Her to see the letter and Richard J. Gabriel's Memorandum of what was discussed and supposedly agreed to at this meeting.  Please note the following from Richard J. Gabriel's Memorandum:

        • Claims that Eugene Villeneuve wants Richard Gabriel to represent him then says he has not spoken to Eugene Villeneuve since May.

        • Note Item 7(a) where Richard Gabriel agrees to step aside if Pamela Constanzo is paid to care for his father.  Pamela Constanzo never cared for her father - he had home health workers AND had nothing to do with her father until Annette Villeneuve died and she took over.  PAMELA CONSTANZO GETS NOTHING IN THE WILL YET RICHARD GABRIEL THINKS SHE SHOULD BE COMPENSATED BY THE ESTATE WHICH IS COUNTER TO ANNETTE VILLENEUVE"S WILL WHICH STATES THAT "I have intentionally made no provision for my granddaughter, PAMELA CONTANZO, of Marlborogh, Massachusetts, and it is my intention that she receive no part of my estate."

        • Note Item 5 where he state Eugene Villeneuve only wants the furniture and James P. Pazzanese can take whatever he wants.  He had no legal right - he is not the Executor - to state this.

  • November 26, 2007

    • Pre-Trial Hearing was held.  Present were attorney's William Crowley, Alan Garber, and Richard Gabriel.

      • Special Administrator Crowley told the judge he was not prepared for the hearing.

      • Richard Gabriel said he would step aside if James P. Pazzanese would sign his Memorandum agreeing to the terms.  James P. Pazzanese told the judge he was handed this document as they entered the court room and he would not sign anything Richard Gabriel drew up without reading it.

      • Attorney Kurt Hayes, who had been notified of the hearing and was still the attorney of record fails to show up for the hearing.

      • Pre-Trial Hearing was rescheduled for December 14, 2007 in Marlborogh, Massachusetts.

    • Eugene Villeneuve dies at 5:02 A.M. in the nursing home or at Marlborogh Hospital after being promised for months by Pamela Constanzo that he would be going home soon. 

      • No attorney present notified the judge of this fact yet within minutes of the hearing ending Deborah Peterson Boulay called William Crowley to notify him of the death.

      • No longer can the parties in the case hide behind Eugene Villeneuve claiming to be trying to protect him.  HE WAS NOW DEAD and per the terms of the Will the properties were now owned by James P. Pazzanese the second Eugene Villeneuve died.

  • On or Around December 11, 2007

    • Monique Boucher Lamb enters the case and agreed to get an acceptable admistrator appointed for a flat rate of $3,000.00 in which there are three witnesses who can attest to this fact.

    • With Eugene Villeneuve dead there was nothing to fight over - James P. Pazzanese gets the real estate, the bills can be paid, Bequests be made, and remainder interests given what was left.  All that was required was the paper work to be filed.

  • December 15, 2007

    • Judge McSeeney III was unable to attend the hearing due to a snow storm.  Hearing was rescheduled for February 15, 2008.

  • On or About January 7, 2008

    • Monique Boucher Lamb calls a  meeting with James P. Pazzanese.  She only wants to discuss selling the properties.  She is told that the properties will not be sold

  • January 18, 2008

    • Monique Boucher Lamb sends James P. Pazzanese a letter asking for $50,000.00 to handle the estate matters only.  This letter was filed with an Objection to Monique Boucher Lamb's Motion to Withdraw from this case which is public record.  Click Here to See Letter.

        • She wants half on February 10, 2008 - five days before the next hearing.

        • Claims it is a "Complicated Case".  Eugene Villeneuve is dead - there is nothing complicated about this case at this point - paperwork to appoint an Administrator needs to be filed.

  • February 15, 2008

    • Pre-Trial Hearing was held in Marlborogh, Massachusetts

    • File could not be found - WHAT A SURPRISE!!!!!!  JUDGE SAID HE WAS FAMILIAR WITH THE CASE AND COULD HEAR IT.

    • Monique Boucher Lamb asks about her Motion to Withdraw and the Judge said "We are not going there".  Also, she has not filed the form that William Crowley told her was needed in his letter to her dated January 25, 2008.

    • Attorneys present were Richard J. Gabriel, William Crowley, and Monique Boucher Lamb.

    • Richard J. Gabriel tells the judge repeatedly that he will withdraw if he is paid his fees.

    • John J. Pazzanese, a remainder interest in the case, testifies as follows (THIS IS PARAPHRASED):

      • We believe the Codicil to be invalid due to the Notary on the document also being a witness on the Codicil and his belief that it is illegal to notarize your own signature.  Richard J. Gabriel has been telling attorneys that he would withdraw if his fees were paid for several months yet is still here.  The reason James P. Pazzanese has objected to Richard J. Gabriel being paid is that NO ATTORNEY WILL ANSWER THE QUESTION WHICH IS - IF JAMES P. PAZZANESE AGREES TO ALLOW RICHARD J. GABRIEL TO BE PAID CAN THE ESTATE TAKE LEGAL ACTION AGAINST RICHARD J. GABRIEL IF WRONG DOING IS DISCOVERED LATER ON?

      • The judge answered "I don't see why not".

      • John J. Pazzanese then states to the judge that the Motion Challenging the Codicil will be withdrawn AFTER Richard J. Gabriel steps aside - not before since he has been telling lawyers for months he would step aside if his fees are paid and he is still here.  We agree to his fees being paid - period - there will be no confidentiality, non-disclosure, or any other nonsense.

      • Todd Villeneuve stands up and states "I am the grandson of Annette Villeneuve and son of Eugene Villeneuve" - that was as far as he got - Richard J. Gabriel swings around screaming "he is nothing - just a remainder interest".

        • We have heard that Richard J. Gabriel told Todd Villeneuve to go to the hearing and say that the Villeneuve grandchildren want him as Executor and then they can go to his office and he will pay them what they have coming.  As remainder interests they can not be paid until all the bills are paid and bequests made.

      • The judge then orders the attorneys to write up the agreement to Richard J. Gabriel stepping aside in the hall and not to leave the court house until this was drawn up and signed by all parties.

      • Attorney Monique Boucher Lamb writes up the agreement.   Richard Gabriel refuses to sign it after he has told the judge he would step aside if his fees were paid which the agreement provided for.

      • There was such a commotion in the hall the judge heard it and called the attorneys into chambers to find out what was going on.  I believe he was told t that Richard J. Gabriel would not sign the agreement since the estate could sue him.  It is not known what the judge told Richard Gabriel in chambers - possibly that he would rule the Codicil invalid or charge him with perjury - Richard Gabriel signed the document, the case was called a second time for a ruling on the document, and Richard J. Gabriel stormed out of the court house.

      • The judge told the attorneys in open court that an Administrator will be appointed at the next hearing on March 13, 2008 and if the parties can not agree on one he will appoint one.

  • March 13, 2008

    • Monique Boucher Lamb shows up in court and has not filed the necessary documents to have Joseph Navin appointed Administrator although all parties have assented to him being appointed.

    • The case was called and the bailiff asked for the paperwork.  I have heard Monique Boucher Lamb told the bailiff that this case will be continued for a few more months at which point the bailiff told her that this case is over today - go get the forms and fill them out.  Monique Boucher Lamb then told the bailiff it costs money to file the forms and James P. Pazzanese has used up his retainer at which point the bailiff said something like "he paid you $$5,000.00 on February 15, 2008 and it is used up - go get the forms, fill them out, and we will call some other cases first". When the forms were completed the case was called and Joseph Navin was appointed Administrator.

      • When the court order making Joseph Navin Administrator was not received within a week James P. Pazzanese went to the court house to get a copy.

    • William Crowley told the judge he would bring the files to Mr. Navin's office in Cambridge on Monday March 16, 2008.  He didn't show up.  Mr. Navin left him phone messages which were ignored.  After James P. Pazzanese secured the court order William Crowley called Joseph Navin the next day.  He has yet to turn over all the records to Administrator Joseph Navin and is demanding more fees and $800.00 to deliver the documents.  Has he heard of UPS?????  IS HE HIDING SOMETHING?????

  • May 22, 2008

    • Monique Boucher Lamb filed another Motion to Withdraw which was heard.  The judge "Took it Under Advisement" and didn't rule.
