  • At the Pre-Trial Conference on November 26, 2007 he handed this document to James P. Pazzanese as the case was called and wanted him to sign it without reading it and James P. Pazzanese refused.  Eugene Villeneuve Jr. had died at 5:02 A.M. that morning but the judge was not told of this.  If Richard J. Gabriel knew about this at the time of the hearing this is a serious omission.

  • Note that the date of the memorandum is November 26, 2007
  • Did he write this before or after he found out Eugene Villeneuve Jr. was dead???  In court he told the judge that he didn't think Eugene Villeneuve was incompetent and then states in this document that he is.
  • The Pre-Trial Conference was scheduled on September 20, 2007 yet William Crowley was not ready to proceed after witnesses had flown in from Houston, Texas to testify.  It was rescheduled for December 14, 2007 in Marlborogh, MA.

 

• Due to a snow storm Judge McSweeney, III was unable to attend the hearing in Marlborogh, MA so it was rescheduled for February 15, 2008 in Marlborogh, MA.

• February 15, 2008 hearing is held in Marlboro, MA and Richard J. Gabriel agrees to step aside.  He told the judge in open court he would step aside if his fees were paid and then tried to renege on his agreement in the hall of the court.  The judge heard the commotion in the hall, called a recess, and called Special Administrator William Crowley, Attorney Monique Boucher Lamb, and Attorney Richard J. Gabriel into chambers.  It is not known what was said in chambers but Richard J. Gabriel signed the paperwork to step aside.  A final hearing was scheduled for March 13, 2008 in Cambridge.

 

• We have heard when the case was called on March 13, 2008 in Cambridge, MA attorney Monique Boucher Lamb had not filled out the paperwork to appoint Joseph Na Administrator even though every beneficiary had responded agreeing to him.  We have heard that she told the judge's clerk that this case will not be finished today and will be continued for a few months.  The judge's clerk gave her the forms and told her to fill them out immediately for submission to the judge since this case is ending today.  She filled out the forms and Joseph Navin was appointed Administrator.
